Welcome to Hearth Outpost.

These Terms of Service (“Terms”) govern your access to and use of www.hearthoutpost.com (the “Site”) and your purchase of products or services from Hearth Outpost Stores LLC.

Throughout these Terms, “Hearth Outpost,” “we,” “us,” and “our” refer to:

By accessing the Site, creating an account, placing an order, or otherwise using our services, you agree to these Terms.

If you do not agree to these Terms, you should not use the Site.

These Terms should be read together with our Privacy Policy, Shipping Policy, Return & Refund Policy, and any other policies or terms displayed on the Site that apply to a particular purchase or service.

1. Eligibility and Use of the Site

You must be at least 18 years old or the age of legal majority in your jurisdiction to make a purchase through the Site.

By using the Site, you represent that:

  • You have the legal capacity to enter into a binding agreement;

  • Information you provide to us is accurate and complete;

  • You will use the Site only for lawful purposes; and

However, manufacturers may change product designs, specifications, components, packaging, colors, features, or other characteristics without notice.

  • Manufacturer updates;

  • Product configuration;

  • Natural variations in materials or finishes; or

  • Other factors outside our reasonable control.

Product photographs may include accessories, furnishings, decorative elements, installation components, or other products that are not included unless expressly stated in the product description.

You are responsible for reviewing the product description and included components before purchasing.

If you have questions about product specifications, compatibility, dimensions, installation requirements, fuel type, electrical requirements, clearances, or other important characteristics, we encourage you to contact Hearth Outpost before placing your order.

3. Product Availability

All products are subject to availability.

Some products displayed as available may be stored or fulfilled by a manufacturer, distributor, supplier, warehouse, or other fulfillment partner rather than directly by Hearth Outpost.

Inventory information can change rapidly and may occasionally be inaccurate due to supplier inventory updates, simultaneous orders, discontinued products, manufacturer changes, or technical issues.

We reserve the right to:

  • Limit quantities;

  • Discontinue products;

  • Change product availability;

  • Refuse or cancel orders for unavailable products; or

  • Offer an alternative where appropriate.

If we cancel an order because a product is unavailable, any amount paid for the canceled portion of the order will be refunded using the applicable payment method.

4. Pricing

Unless otherwise stated, prices displayed on the Site are in U.S. dollars.

Prices may change at any time before an order is accepted.

Product prices generally do not include applicable:

  • Sales or use taxes;

  • Shipping charges;

  • Freight charges;

  • Delivery services;

  • Installation;

  • Assembly;

  • Permits;

  • Site preparation;

  • Utility work; or

  • Other services,

unless specifically stated otherwise.

Any applicable charges that Hearth Outpost collects will be disclosed during the purchase process before you complete your order.

5. Pricing and Listing Errors

Although we make reasonable efforts to maintain accurate information, errors may occasionally occur.

These may include errors involving:

  • Product description;

  • Promotional pricing;

  • Discounts;

  • Availability;

  • Specifications;

  • Shipping charges;

  • Product configuration; or

  • Other information.

If an obvious pricing or listing error is discovered before an order has been accepted, we reserve the right to correct the error or cancel the affected order.

If payment has already been collected for an order that we cancel, we will refund the applicable amount.

We will not knowingly substitute a different product or charge a higher price without informing you and obtaining any authorization required by law.

6. Orders and Order Acceptance

Submitting an order through the Site constitutes an offer to purchase the products in your order.

An automated email, webpage confirmation, payment authorization, or other acknowledgement that we received your order does not necessarily mean that your order has been accepted.

We reserve the right to verify and accept an order after reviewing matters such as:

  • Payment authorization;

  • Shipping eligibility;

  • Fraud indicators;

  • Customer information;

  • Supplier availability; and

  • Other reasonable order requirements.

We may refuse or cancel an order where reasonably necessary, including if:

  • A product is unavailable;

  • A pricing or product listing error occurred;

  • Payment cannot be authorized;

  • We suspect fraud or unauthorized activity;

  • Shipping cannot reasonably be completed to the requested location;

  • The order violates manufacturer or supplier restrictions;

  • The order violates these Terms; or

  • We are otherwise legally permitted to do so.

If we cancel an order after collecting payment, we will refund the applicable amount unless another remedy is agreed upon with you.

7. Payment

You agree to provide current, complete, and accurate payment and billing information.

You represent that you are authorized to use the payment method provided.

By submitting payment information, you authorize us and our payment providers to charge your selected payment method for amounts associated with your order, including applicable taxes, shipping charges, and other charges disclosed before purchase.

Payment processing may be performed by third-party payment processors.

Hearth Outpost generally does not directly store complete payment card numbers.

Orders may be subject to additional verification for fraud prevention and security purposes.

8. Sales Tax

Hearth Outpost will collect sales tax where required by applicable law.

The amount of tax collected may depend on factors including the shipping destination, product type, applicable tax rules, and available exemptions.

If you claim a sales-tax exemption, you are responsible for providing valid and complete exemption documentation before an order is processed where required.

Customers may be responsible for use tax or other taxes that Hearth Outpost is not legally required to collect.

Hearth Outpost may make financing, installment payment, buy-now-pay-later, or other third-party payment options available.

Such services are provided by independent third parties and may be subject to:

Unless expressly stated otherwise, Hearth Outpost is not the lender and does not make credit decisions.

Approval for financing does not guarantee product availability or acceptance of an order.

10. Shipping and Delivery

Shipping and delivery are governed by our separate Shipping Policy, which is incorporated into these Terms by reference.

Shipping dates, handling times, transit times, and delivery estimates are estimates unless expressly stated otherwise.

Delivery may be affected by circumstances outside our reasonable control, including:

  • Manufacturer delays;

  • Supplier delays;

  • Freight carrier delays;

  • Weather;

  • Natural disasters;

  • Transportation disruptions;

  • Labor disruptions;

  • Supply-chain conditions;

  • Government actions;

  • Incorrect delivery information;

  • Remote delivery locations; or

  • Other circumstances beyond our reasonable control.

Large or heavy products may be delivered by freight carrier and may require special delivery arrangements.

Customers are responsible for providing accurate delivery information and ensuring that the delivery location can reasonably accommodate the ordered product.

Additional requirements for freight delivery, inspection, delivery appointments, damaged shipments, remote areas, and related matters may be provided in our Shipping Policy or during checkout.

Nothing in these Terms alters any shipping or delivery rights provided to consumers by applicable law.

11. Freight Deliveries and Inspection

Many products sold by Hearth Outpost are large, heavy, fragile, or high-value products that may be shipped by freight carrier.

Where reasonably possible, customers should inspect freight shipments promptly upon delivery.

If packaging or a product appears visibly damaged, customers should document the condition through photographs and note visible damage with the carrier where appropriate.

Customers should contact Hearth Outpost promptly if a shipment arrives damaged, incomplete, or materially different from the order.

Specific freight-damage procedures are described in our Shipping Policy.

Failure to follow recommended inspection procedures will not waive rights that cannot legally be waived under applicable law.

12. Returns, Refunds, Exchanges, and Cancellations

Returns, refunds, exchanges, order cancellations, and related charges are governed by our separate Return & Refund Policy, which is incorporated into these Terms by reference.

Because many Hearth Outpost products are large, high-value, special-order, configured, freight-shipped, or fulfilled directly by manufacturers or distributors, return and cancellation eligibility may vary by product.

You should review the Return & Refund Policy before purchasing.

The Return & Refund Policy will disclose applicable requirements such as:

  • Eligibility for returns;

  • Return timeframes;

  • Product condition requirements;

  • Return authorization procedures;

  • Return shipping responsibility;

  • Restocking charges, if any;

  • Non-returnable products, if applicable;

  • Cancellation conditions; and

  • Refund processing.

Nothing in these Terms or our Return & Refund Policy limits rights that cannot legally be limited under applicable consumer-protection law.

13. Special-Order and Configured Products

Certain products may be manufactured, ordered, modified, finished, or configured specifically based on customer selections.

Examples may include products involving selected:

  • Finishes;

  • Colors;

  • Sizes;

  • Fuel types;

  • Ignition systems;

  • Accessories;

  • Components;

  • Custom configurations; or

  • Manufacturer options.

The Site will identify relevant product options during the purchase process where applicable.

Special-order, made-to-order, customized, or configured products may be subject to different cancellation or return conditions as disclosed in our Return & Refund Policy.

Customers are responsible for reviewing their selected configuration before completing an order.

14. Installation and Product Requirements

Unless expressly stated otherwise, products purchased from Hearth Outpost do not include professional installation.

Many products we sell may require installation, assembly, gas connections, electrical connections, plumbing, ventilation, foundations, structural support, clearances, permits, inspections, or other site-specific work.

You are responsible for determining whether a product is suitable for your intended location and complying with applicable:

  • Building codes;

  • Fire codes;

  • Electrical codes;

  • Gas codes;

  • Permits;

  • Homeowners association rules;

  • Manufacturer instructions; and

  • Other legal or safety requirements.

Where professional installation is required or recommended, installation should be performed by an appropriately qualified or licensed professional.

Hearth Outpost is not responsible for improper installation, unauthorized modifications, failure to follow manufacturer instructions, or use of a product in an unsuitable environment, except to the extent responsibility cannot legally be excluded.

15. Manufacturer Instructions and Safety

Customers must use products in accordance with applicable manufacturer instructions, manuals, warnings, safety information, installation requirements, and maintenance guidelines.

Certain products, including grills, fire features, heating appliances, gas products, electrical products, and outdoor cooking equipment, can present risks if improperly installed, operated, maintained, or located.

You are responsible for reading and following applicable manufacturer safety instructions.

16. Manufacturer Warranties

Many products sold by Hearth Outpost include warranties provided by their manufacturer.

Manufacturer warranty coverage varies by brand and product and may include specific:

  • Warranty periods;

  • Registration requirements;

  • Coverage limitations;

  • Installation requirements;

  • Maintenance requirements; and

  • Claims procedures.

Where available, Hearth Outpost may assist customers in obtaining warranty information or communicating with a manufacturer.

However, manufacturer warranties are ultimately governed by the applicable manufacturer's warranty terms.

Nothing in these Terms eliminates or limits any warranty, statutory right, or remedy that cannot legally be excluded.

17. Authorized Dealer Status

Where Hearth Outpost identifies itself as an authorized dealer of a particular brand, that representation applies based on our relationship with the applicable manufacturer, distributor, or authorized supplier at the relevant time.

Brand names and trademarks remain the property of their respective owners.

Unless expressly stated, Hearth Outpost is an independent retailer and is not owned or operated by the manufacturers whose products we sell.

18. Promotions and Discount Codes

Promotions, discount codes, coupons, gifts, rebates, and special offers may be subject to additional terms disclosed with the promotion.

Unless otherwise stated:

  • Promotions have no cash value;

  • Promotions cannot be combined if the promotion states otherwise;

  • Promotions may exclude certain brands or products;

  • Promotional eligibility may be limited;

  • Promotions may expire; and

  • Discounts generally cannot be applied retroactively to completed purchases.

We reserve the right to correct or cancel promotions that contain obvious errors or are used fraudulently or contrary to their stated terms.

19. Price Matching

If Hearth Outpost offers a price-match or price-protection program, eligibility and conditions will be governed by the applicable terms displayed on the Site.

The existence of a price-match request does not modify an order until Hearth Outpost confirms the adjustment.

20. Gift Cards and Store Credit

If Hearth Outpost offers gift cards or store credits, additional terms may apply.

Gift cards and store credits are not redeemable for cash except where required by law.

Expiration and fee rules will comply with applicable law.

21. Customer Accounts

You may have the option to create a customer account.

You are responsible for:

  • Maintaining the confidentiality of your login credentials;

  • Providing accurate account information;

  • Maintaining the security of your account; and

  • Promptly notifying us if you believe your account has been accessed without authorization.

We may suspend or restrict an account when reasonably necessary to protect customers, investigate fraud, maintain Site security, or enforce these Terms.

22. Reviews, Photographs, and User-Submitted Content

The Site may allow customers to submit:

  • Ratings;

  • Photographs;

  • Questions;

  • Comments;

  • Testimonials; or

You retain ownership of content you submit.

By submitting content for public display, you grant Hearth Outpost a non-exclusive, worldwide, royalty-free license to host, reproduce, display, distribute, adapt, and use that content in connection with our Site, products, customer communications, advertising, and marketing, subject to applicable law.

You represent that you have the right to submit the content and that it does not:

  • Infringe another person's rights;

  • Contain unlawful material;

  • Contain malicious code;

  • Misrepresent your experience;

  • Impersonate another person; or

  • Violate applicable law.

We may moderate or remove content where reasonably appropriate.

We do not guarantee that every submitted review or comment will be published.

23. Intellectual Property

The Site and its content, including where applicable:

  • Text;

  • Graphics;

  • Logos;

  • Page layouts;

  • Design elements;

  • Photography;

  • Videos;

  • Product guides;

  • Editorial content;

  • Software;

  • Icons; and

  • Other materials,

are owned by Hearth Outpost, licensed to Hearth Outpost, or used with permission.

They are protected by applicable intellectual-property laws.

Manufacturer names, product names, trademarks, logos, product images, and other brand materials may belong to their respective owners.

You may use the Site for ordinary shopping and informational purposes.

You may not, without authorization:

  • Reproduce substantial portions of the Site;

  • Republish Site content;

  • Scrape or systematically extract Site content;

  • Sell or commercially exploit Site content;

  • Remove copyright or trademark notices;

  • Misrepresent affiliation with Hearth Outpost; or

  • Use Hearth Outpost intellectual property in a manner likely to cause confusion.

24. Prohibited Uses

You may not use the Site:

  • To commit fraud;

This section applies primarily to the Site and informational content and does not eliminate rights regarding products purchased from Hearth Outpost that cannot legally be waived.

31. Limitation of Liability

To the maximum extent permitted by applicable law, Hearth Outpost Stores LLC and its officers, employees, agents, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the Site or a transaction with Hearth Outpost where such damages may lawfully be excluded.

This may include, where permitted by law, loss of profits, loss of business opportunity, loss of data, or similar indirect losses.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability that applicable law imposes for certain personal injuries, fraud, intentional misconduct, gross negligence, statutory consumer rights, or other non-waivable obligations.

Your rights regarding defective, damaged, nonconforming, or undelivered products remain subject to applicable law and our applicable store policies.

32. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold Hearth Outpost harmless from claims, liabilities, losses, and reasonable expenses arising from your:

  • Unlawful use of the Site;

  • Fraudulent activity;

  • Violation of these Terms;

  • Infringement of another person's intellectual-property rights; or

  • User-submitted content that violates these Terms.

This provision does not require a consumer to indemnify Hearth Outpost for Hearth Outpost's own unlawful conduct, negligence, or obligations that cannot legally be transferred.

33. Events Beyond Our Reasonable Control

Hearth Outpost will not be responsible for delay or failure to perform obligations caused by circumstances beyond our reasonable control, except where applicable law provides otherwise.

Such circumstances may include:

  • Natural disasters;

  • Severe weather;

  • Fires;

  • Flooding;

  • War;

  • Terrorism;

  • Civil unrest;

  • Government actions;

  • Public health emergencies;

  • Labor disruptions;

  • Transportation interruptions;

  • Carrier failures;

  • Supplier or manufacturer disruptions;

  • Utility outages;

  • Internet or communications failures; or

  • Other events beyond our reasonable control.

This section does not eliminate obligations to provide refunds, remedies, or other consumer rights where required by law.

34. Governing Law

These Terms and transactions with Hearth Outpost are governed by the laws of the State of Delaware and applicable federal law, without regard to conflict-of-law principles, except where the laws of your state of residence provide mandatory consumer protections that cannot legally be waived.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to transactions under these Terms to the extent its exclusion is permitted.

35. Disputes and Jurisdiction

We encourage customers to contact Hearth Outpost first if a dispute arises so that we have an opportunity to resolve the issue.

Where permitted by applicable law, disputes arising from these Terms or your relationship with Hearth Outpost that cannot be resolved informally will be subject to the jurisdiction of the appropriate state or federal courts located in Delaware.

Nothing in this section prevents a consumer from exercising rights or using a forum that applicable law requires to remain available.

36. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permissible or severed where necessary.

The remaining provisions will continue in effect.

37. No Waiver

If Hearth Outpost does not immediately enforce a provision of these Terms, that does not constitute a waiver of our right to enforce that provision later.

A waiver of one provision or violation does not constitute a waiver of another provision or future violation.

38. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior consent where consent may lawfully be required.

Hearth Outpost may assign these Terms in connection with a merger, acquisition, corporate restructuring, sale of assets, financing, or similar business transaction, subject to applicable law.

39. Entire Agreement

These Terms, together with applicable policies and terms referenced in them, constitute the agreement between you and Hearth Outpost regarding use of the Site and purchases made through it.

Product-specific terms displayed before purchase may supplement these Terms.

If a product-specific term directly conflicts with a general provision in these Terms, the more specific disclosed term will control to the extent legally permitted.

40. Changes to These Terms

We may update these Terms from time to time to reflect changes in:

  • Our business;

  • Site functionality;

  • Products or services;

  • Legal requirements; or

  • Business practices.

When we update these Terms, we will revise the Last Updated date.

Changes generally apply prospectively and will not retroactively alter the material terms of a completed transaction unless permitted by law or agreed with you.
